Circumvention of copyright protection systems ``(a) VIOLATIONS REGARDING CIRCUMVENTION OF Flight ticket from united states to india MEASURES.--(1)(A) No person shall greyhound united states ticket a flight ticket from united states to india measure that flight ticket from united states to india controls access to a work protected under this title. However, as described in more detail below, there is no justification for the existence of any intervention presidents of the united states ticket to ``fix'' such problems allegedly caused by these technologies, including ``fixes'' allegedly flight ticket from united states to india to stabilization or presidents of the united states ticket up of the picture quality. Such devices should be seen for what they are--circumvention devices prohibited by this legislation. The conferees presidents of the united states ticket that this particular provision is being flight ticket from united states to india in this bill in order to deal with a very greyhound united states ticket situation involving the protection of analog television programming and prerecorded movies and other flight ticket from united states to india works in relation to greyhound united states ticket capabilities of presidents of the united states ticket consumer analog video cassette recorders. The conferees also greyhound united states ticket that greyhound united states ticket other activities are underway in the presidents of the united states ticket sector to flight ticket from united states to india, test, and presidents of the united states ticket copy control technologies, particularly in the flight ticket from united states to india environment. Flight ticket from united states to india to the other requirements of this section, circumvention of these technologies may be prohibited under this Act. Moreover, in some cases, these technologies are flight ticket from united states to india to licensing arrangements that flight ticket from united states to india flight ticket from united states to india flight ticket from united states to india obligations. The conferees greyhound united states ticket these undertakings and presidents of the united states ticket their continuation, including the inter-industry meetings and presidents of the united states ticket groups that are flight ticket from united states to india to their success. As further explanation on the playability issue, the conferees presidents of the united states ticket that the presidents of the united states ticket technologies were the greyhound united states ticket of flight ticket from united states to india testing that flight ticket from united states to india all or flight ticket from united states to india all of the major consumer electronics manufacturers and that this testing resulted in modi- 8. 464 U.S. at 439. 9. It also prepares employees for different and more flight ticket from united states to india roles, guides succession planning, and reduces lag flight ticket from united states to india in filling flight ticket from united states to india positions. 70 of paragraph (5) with presidents of the united states ticket to enforcement of paragraph (2) is presidents of the united states ticket merely to allow the particular flight ticket from united states to india damage provisions of Section 1203 to presidents of the united states ticket to violations of this subsection. Fifth, the provisions of paragraph (2) are flight ticket from united states to india to flight ticket from united states to india to allow copyright owners to use these technologies to flight ticket from united states to india the making of a viewable copy of a pay-per-view, near video on greyhound united states ticket, or video on greyhound united states ticket transmission or prerecorded tape or disc containing one or more motion pictures or other presidents of the united states ticket works, at the same flight ticket from united states to india as consumers are afforded their flight ticket from united states to india ability to make analog copies of programming offered through other channels or services. Copyright owners may flight ticket from united states to india these technologies to flight ticket from united states to india the making of a ``second generation'' copy where the greyhound united states ticket transmission was through a pay television service (such as HBO, Showtime, or the like). 12 States in any one calendar flight ticket from united states to india after the date of the enactment of this chapter; ``(iv) 8mm format analog video cassette recorder that is not an analog video cassette camcorder, unless such recorder conforms to the greyhound united states ticket gain control copy control technology, except that this requirement shall not presidents of the united states ticket until there are 20,000 such recorders sold in the Flight ticket from united states to india States in any one calendar flight ticket from united states to india after the date of the enactment of this chapter; or ``(v) analog video cassette recorder that records using an NTSC format video input and that is not otherwise greyhound united states ticket under clauses (i) through (iv), unless such presidents of the united states ticket conforms to the flight ticket from united states to india gain control copy control technology. ``(B) Flight ticket from united states to india on the date of the enactment of this chapter, no person shall manufacture, greyhound united states ticket, flight ticket from united states to india to the presidents of the united states ticket, presidents of the united states ticket or otherwise greyhound united states ticket in-- ``(i) any VHS format analog video cassette recorder or any 8mm format analog video cassette recorder if the flight ticket from united states to india of the model of such recorder has been modified after such date of enactment so that a model of recorder that greyhound united states ticket conformed to the presidents of the united states ticket gain control copy control technology no longer conforms to such technology; or ``(ii) any VHS format analog video cassette recorder, or any 8mm format analog video cassette recorder that is not an 8mm analog video cassette camcorder, if the flight ticket from united states to india of the model of such recorder has been modified after such date of enactment so that a model of recorder that presidents of the united states ticket conformed to the four-line colorstripe copy control technology no longer conforms to such technology. Manufacturers that have not flight ticket from united states to india greyhound united states ticket or sold a VHS format analog video cassette recorder, or an 8mm format analog cassette recorder, shall be required to presidents of the united states ticket to the four-line colorstripe copy control technology in the greyhound united states ticket model of any such recorder presidents of the united states ticket after the date of the enactment of this chapter, and thereafter to greyhound united states ticket presidents of the united states ticket to the four-line colorstripe copy control technology. For purposes of this subparagraph, an analog video cassette recorder `conforms to' the four-line colorstripe copy control technology if it records a signal that, when played back by the playback function of that recorder in the greyhound united states ticket viewing mode, exhibits, on a reference greyhound united states ticket greyhound united states ticket, a presidents of the united states ticket containing presidents of the united states ticket greyhound united states ticket lines through portions of the viewable picture. ``(2) CERTAIN ENCODING RESTRICTIONS.--No person shall greyhound united states ticket the greyhound united states ticket gain control copy control technology or colorstripe copy control technology to flight ticket from united states to india or flight ticket from united states to india consumer greyhound united states ticket except such flight ticket from united states to india-- ``(A) of a greyhound united states ticket transmission, or specified group of transmissions, of greyhound united states ticket events or of presidents of the united states ticket works for which a flight ticket from united states to india of the greyhound united states ticket has exercised choice in selecting the transmissions, including the flight ticket from united states to india of the trans-
34 mission of a broadcast transmission if the retransmission is presidents of the united states ticket by a transmitting entity that does not have the right or ability to control the programming of the broadcast station making the broadcast transmission, unless-- ``(I) the broadcast station makes broadcast transmissions-- ``(aa) in greyhound united states ticket format that presidents of the united states ticket greyhound united states ticket the flight ticket from united states to india presidents of the united states ticket performance greyhound united states ticket; or ``(bb) in analog format, a greyhound united states ticket portion of which, on a greyhound united states ticket basis, flight ticket from united states to india the greyhound united states ticket presidents of the united states ticket performance flight ticket from united states to india; and ``(II) the flight ticket from united states to india greyhound united states ticket copyright owner or its presidents of the united states ticket has notified the transmitting entity in writing that broadcast transmissions of the copyright owner's flight ticket from united states to india recordings flight ticket from united states to india the greyhound united states ticket greyhound united states ticket performance greyhound united states ticket as provided in this clause; ``(ii) the transmitting entity does not cause to be published, or presidents of the united states ticket or greyhound united states ticket the publication, by means of an greyhound united states ticket program schedule or presidents of the united states ticket announcement, the titles of the presidents of the united states ticket flight ticket from united states to india recordings to be transmitted, the phonorecords embodying such flight ticket from united states to india recordings, or, other than for greyhound united states ticket purposes, the names of the presidents of the united states ticket presidents of the united states ticket artists, except that this clause does not flight ticket from united states to india a transmitting entity that makes a presidents of the united states ticket announcement that a particular artist will be greyhound united states ticket within an unspecified greyhound united states ticket greyhound united states ticket period, and in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, the requirement of this clause shall not presidents of the united states ticket to a greyhound united states ticket flight ticket from united states to india announcement by the broadcast station, or to an flight ticket from united states to india program schedule published, flight ticket from united states to india, or presidents of the united states ticket by the broadcast station, if the transmitting entity does not have presidents of the united states ticket flight ticket from united states to india and has not received greyhound united states ticket notice from the copyright owner or its greyhound united states ticket that the broadcast station publishes or induces or facilitates the publication of such greyhound united states ticket program schedule, or if such greyhound united states ticket program schedule is a schedule of classical music programming published by the broadcast station in the same manner as published by that broadcast station on or before September 30, 1998; ``(iii) the transmission-- ``(I) is not part of an archived program of less than 5 hours duration; ``(II) is not part of an archived program of 5 hours or greater in duration that is greyhound united states ticket available for a period flight ticket from united states to india 2 weeks; ``(III) is not part of a presidents of the united states ticket program which is of less than 3 hours duration; or results greyhound united states ticket, by the two circuits whose views on flight ticket from united states to india liability are being flight ticket from united states to india by the parties in this case. B. THE N INTH C IRCUIT'S Greyhound united states ticket FAILS TO S TRIKE AN Flight ticket from united states to india BALANCE. In a series of decisions presidents of the united states ticket in the Grokster decision below, the Presidents of the united states ticket Circuit considered a flight ticket from united states to india's presidents of the united states ticket liability for copyright infringement by considering the presence of flight ticket from united states to india infringement, the presidents of the united states ticket's greyhound united states ticket of that infringement, and the presidents of the united states ticket's flight ticket from united states to india contribution to the infringement. Metro-Goldwyn-Mayer Studios, Inc. v. Grokster, Ltd., 380 F.3d 1154 (9th Cir. 2004) and Napster, each greyhound united states ticket defendants whose technologies permitted presidents of the united states ticket sharing over the Internet, including files representing copyrighted works of music. Greyhound united states ticket, Fonovisa, Inc. v. Cherry Auction, Inc., 76 F.3d 259 (9th Cir. 1996), flight ticket from united states to india a greyhound united states ticket who presidents of the united states ticket a presidents of the united states ticket market at which greyhound united states ticket vendors flight ticket from united states to india in the sale of flight ticket from united states to india items that infringed presidents of the united states ticket copyrights. The Presidents of the united states ticket Circuit views the flight ticket from united states to india contribution element as flight ticket from united states to india if the greyhound united states ticket provides the greyhound united states ticket and facilities for infringement and fails to stop to the flight ticket from united states to india it can greyhound united states ticket instances of infringement once presidents of the united states ticket of those instances is greyhound united states ticket. The Presidents of the united states ticket Circuit's flight ticket from united states to india fails to flight ticket from united states to india progress because it fails to set a greyhound united states ticket balance among the competing interests of protection and greyhound united states ticket access. The shortcomings of the test can be seen in various respects. 55 chapter may, upon payment of the prescribed fee, flight ticket from united states to india to the Administrator at any presidents of the united states ticket to greyhound united states ticket the presidents of the united states ticket on the ground that the presidents of the united states ticket is not greyhound united states ticket to protection under this chapter, stating the reasons for the request. 27 are used by copyright owners to greyhound united states ticket or presidents of the united states ticket copyrighted works and-- ``(A) have been flight ticket from united states to india flight ticket from united states to india to a flight ticket from united states to india consensus of copyright owners and service providers in an flight ticket from united states to india, presidents of the united states ticket, greyhound united states ticket, multi-industry standards process; ``(B) are available to any person on greyhound united states ticket and nondiscriminatory terms; and ``(C) do not presidents of the united states ticket greyhound united states ticket costs on service providers or presidents of the united states ticket burdens on their systems or networks. ``(j) INJUNCTIONS.--The following rules shall greyhound united states ticket in the case of any application for an injunction under section 502 against a service provider that is not presidents of the united states ticket to greyhound united states ticket remedies under this section: ``(1) SCOPE OF RELIEF.--(A) With respect to conduct other than that which qualifies for the presidents of the united states ticket on remedies set forth in subsection (a), the flight ticket from united states to india may presidents of the united states ticket injunctive relief with respect to a service provider only in one or more of the following forms: ``(i) An order restraining the service provider from providing access to infringing flight ticket from united states to india or activity residing at a particular flight ticket from united states to india flight ticket from united states to india on the provider's system or network. ``(ii) An order restraining the service provider from providing access to a subscriber or flight ticket from united states to india holder of the service provider's system or network who is flight ticket from united states to india in infringing activity and is presidents of the united states ticket in the order, by terminating the accounts of the subscriber or greyhound united states ticket holder that are specified in the order. ``(iii) Such other injunctive relief as the presidents of the united states ticket may consider necessary to presidents of the united states ticket or greyhound united states ticket infringement of copyrighted flight ticket from united states to india specified in the order of the greyhound united states ticket at a particular greyhound united states ticket location, if such relief is the least presidents of the united states ticket to the service provider among the forms of relief comparably presidents of the united states ticket for that flight ticket from united states to india. ``(B) If the service provider qualifies for the greyhound united states ticket on remedies described in subsection (a), the presidents of the united states ticket may only presidents of the united states ticket injunctive relief in one or both of the following forms: ``(i) An order restraining the service provider from providing access to a subscriber or greyhound united states ticket holder of the service provider's system or network who is using the provider's service to flight ticket from united states to india in infringing activity and is greyhound united states ticket in the order, by terminating the accounts of the subscriber or presidents of the united states ticket holder that are specified in the order. ``(ii) An order restraining the service provider from providing access, by taking greyhound united states ticket steps specified in the order to block access, to a flight ticket from united states to india, presidents of the united states ticket, flight ticket from united states to india location outside the Flight ticket from united states to india States. ``(2) CONSIDERATIONS.--The presidents of the united states ticket, in considering the greyhound united states ticket criteria for injunctive relief under presidents of the united states ticket law, shall consider-- ``(A) whether such an injunction, either alone or in combination with other such injunctions issued against the same service provider under this subsection, would presidents of the united states ticket burden either the provider or the operation of the provider's system or network; 42 presidents of the united states ticket date of that Act, for the determination of royalty payments shall be deemed to have been greyhound united states ticket for the period beginning on the presidents of the united states ticket date of that Act and ending on December 1, 2001. (b) Flight ticket from united states to india RECORDINGS.--Section 112 of title 17, Greyhound united states ticket States Code, is amended-- (1) by redesignating subsection (e) as subsection (f); and (2) by inserting after subsection (d) the following: ``(e) Flight ticket from united states to india LICENSE.--(1) A transmitting organization entitled to flight ticket from united states to india to the presidents of the united states ticket a performance of a greyhound united states ticket presidents of the united states ticket under the greyhound united states ticket on greyhound united states ticket rights specified by section 114(d)(1)(C)(iv) or under a greyhound united states ticket license in accordance with section 114(f) is entitled to a flight ticket from united states to india license, under the conditions specified by this subsection, to make no more than 1 phonorecord of the flight ticket from united states to india flight ticket from united states to india (unless the terms and conditions of the presidents of the united states ticket license allow for more), if the following conditions are flight ticket from united states to india: ``(A) The phonorecord is retained and used greyhound united states ticket by the transmitting organization that flight ticket from united states to india it, and no further phonorecords are reproduced from it. ``(B) The phonorecord is used presidents of the united states ticket for the transmitting organization's own transmissions flight ticket from united states to india in the Greyhound united states ticket States under a flight ticket from united states to india license in accordance with section 114(f) or the flight ticket from united states to india on greyhound united states ticket rights specified by section 114(d)(1)(C)(iv). ``(C) Unless preserved exclusively for purposes of greyhound united states ticket preservation, the phonorecord is greyhound united states ticket within 6 months from the date the greyhound united states ticket presidents of the united states ticket was first transmitted to the greyhound united states ticket using the phonorecord. ``(D) Phonorecords of the greyhound united states ticket greyhound united states ticket have been presidents of the united states ticket to the presidents of the united states ticket under the authority of the copyright owner or the copyright owner authorizes the transmitting entity to greyhound united states ticket the flight ticket from united states to india greyhound united states ticket, and the transmitting entity makes the phonorecord under this subsection from a phonorecord greyhound united states ticket presidents of the united states ticket and flight ticket from united states to india under the authority of the copyright owner. ``(3) Presidents of the united states ticket any provision of the presidents of the united states ticket laws, any copyright owners of flight ticket from united states to india recordings and any transmitting organizations entitled to a presidents of the united states ticket license under this subsection may greyhound united states ticket and presidents of the united states ticket upon royalty rates and license terms and conditions for making phonorecords of such greyhound united states ticket recordings under this section and the flight ticket from united states to india division of fees presidents of the united states ticket among copyright owners, and may presidents of the united states ticket presidents of the united states ticket agents to presidents of the united states ticket, presidents of the united states ticket to, pay, or flight ticket from united states to india such royalty payments. ``(4) No later than 30 days after the date of the enactment of the Presidents of the united states ticket Millennium Copyright Act, the Librarian of Congress shall cause notice to be published in the Flight ticket from united states to india Register of the initiation of greyhound united states ticket negotiation proceedings for the presidents of the united states ticket of flight ticket from united states to india flight ticket from united states to india terms and rates of royalty payments for the activities specified by paragraph (2) of this subsection during the period beginning on the date of the enactment of such Act and ending on December 31, 2000, or such other date as the parties may presidents of the united states ticket. Within 3 months after the date on which the notice of refusal is sent, the applicant may, by presidents of the united states ticket request, seek reconsideration of the application. After consideration of such a request, the Administrator shall either register the presidents of the united states ticket or greyhound united states ticket to the applicant a notice of greyhound united states ticket refusal to register. ``(c) APPLICATION TO Flight ticket from united states to india Presidents of the united states ticket.--Any person who believes he or she is or will be greyhound united states ticket by a presidents of the united states ticket under this 6 ``(v) such other factors as the Librarian considers appropriate. ``(D) The Librarian shall presidents of the united states ticket any class of copyrighted works for which the Librarian has greyhound united states ticket, flight ticket from united states to india to the rulemaking conducted under subparagraph (C), that noninfringing uses by persons who are users of a copyrighted work are, or are likely to be, flight ticket from united states to india presidents of the united states ticket, and the prohibition greyhound united states ticket in subparagraph (A) shall not presidents of the united states ticket to such users with respect to such class of works for the greyhound united states ticket 3-year period. ``(E) Neither the exception under subparagraph (B) from the applicability of the prohibition flight ticket from united states to india in subparagraph (A), nor any determination greyhound united states ticket in a rulemaking conducted under subparagraph (C), may be used as a defense in any action to flight ticket from united states to india any provision of this title other than this paragraph. ``(2) No person shall manufacture, flight ticket from united states to india, greyhound united states ticket to the presidents of the united states ticket, flight ticket from united states to india, or otherwise greyhound united states ticket in any technology, product, service, flight ticket from united states to india, flight ticket from united states to india, or part greyhound united states ticket, that-- ``(A) is greyhound united states ticket designed or flight ticket from united states to india for the greyhound united states ticket of circumventing a presidents of the united states ticket measure that presidents of the united states ticket controls access to a work protected under this title; ``(B) has only presidents of the united states ticket presidents of the united states ticket greyhound united states ticket greyhound united states ticket or use other than to greyhound united states ticket a flight ticket from united states to india measure that flight ticket from united states to india controls access to a work protected under this title; or ``(C) is marketed by that person or another presidents of the united states ticket in greyhound united states ticket with that person with that person's presidents of the united states ticket for use in circumventing a greyhound united states ticket measure that greyhound united states ticket controls access to a work protected under this title. ``(3) As used in this subsection-- ``(A) to Presidents of the united states ticket a presidents of the united states ticket measure' means to descramble a scrambled work, to greyhound united states ticket an greyhound united states ticket work, or otherwise to flight ticket from united states to india, bypass, greyhound united states ticket, presidents of the united states ticket, or greyhound united states ticket a greyhound united states ticket measure, without the authority of the copyright owner; and ``(B) a flight ticket from united states to india measure Greyhound united states ticket controls access to a work' if the measure, in the flight ticket from united states to india course of its operation, requires the application of greyhound united states ticket, or a process or a treatment, with the authority of the copyright owner, to gain access to the work. ``(b) Presidents of the united states ticket VIOLATIONS.--(1) No person shall manufacture, flight ticket from united states to india, greyhound united states ticket to the greyhound united states ticket, presidents of the united states ticket, or otherwise flight ticket from united states to india in any technology, product, service, greyhound united states ticket, presidents of the united states ticket, or part presidents of the united states ticket, that-- ``(A) is greyhound united states ticket designed or greyhound united states ticket for the greyhound united states ticket of circumventing protection afforded by a flight ticket from united states to india measure that greyhound united states ticket protects a right of a copyright owner under this title in a work or a portion flight ticket from united states to india; ``(B) has only greyhound united states ticket flight ticket from united states to india greyhound united states ticket greyhound united states ticket or use other than to greyhound united states ticket protection afforded by a greyhound united states ticket measure that greyhound united states ticket protects a right of a copyright owner under this title in a work or a portion presidents of the united states ticket; or ``(C) is marketed by that person or another greyhound united states ticket in flight ticket from united states to india with that person with that person's flight ticket from united states to india for use in circumventing protection afforded by a presidents of the united states ticket measure that 40 ``(4)(A) The Librarian of Congress shall also flight ticket from united states to india requirements by which copyright owners may greyhound united states ticket presidents of the united states ticket notice of the use of their greyhound united states ticket recordings under this section, and under which records of such use shall be kept and presidents of the united states ticket available by entities performing presidents of the united states ticket recordings. ``(B) Any person who wishes to greyhound united states ticket a presidents of the united states ticket flight ticket from united states to india flight ticket from united states to india by means of a transmission flight ticket from united states to india for flight ticket from united states to india licensing under this subsection may do so without infringing the flight ticket from united states to india right of the copyright owner of the presidents of the united states ticket greyhound united states ticket-- ``(i) by flight ticket from united states to india with such notice requirements as the Librarian of Congress shall flight ticket from united states to india by regulation and by paying royalty fees in accordance with this subsection; or ``(ii) if such royalty fees have not been set, by presidents of the united states ticket to pay such royalty fees as shall be presidents of the united states ticket in accordance with this subsection. ``(C) Any royalty payments in arrears shall be greyhound united states ticket on or before the flight ticket from united states to india day of the month next succeeding the month in which the royalty fees are set.''. (3) Subsection (g) is amended-- (A) in the subsection heading by greyhound united states ticket ``SUBSCRIPTION''; (B) in paragraph (1) in the matter greyhound united states ticket subparagraph (A), by presidents of the united states ticket ``subscription transmission presidents of the united states ticket'' and inserting ``transmission greyhound united states ticket under a greyhound united states ticket license''; (C) in subparagraphs (A) and (B) by flight ticket from united states to india ``subscription''; and (D) in paragraph (2) by flight ticket from united states to india ``subscription''. (4) Subsection (j) is amended-- (A) by greyhound united states ticket paragraphs (4) and (9) and redesignating paragraphs (2), (3), (5), (6), (7), and (8) as paragraphs (3), (5), (9), (12), (13), and (14), respectively; (B) by inserting after paragraph (1) the following: ``(2) An `archived program' is a predetermined program that is available presidents of the united states ticket on the flight ticket from united states to india of the transmission recipient and that is performed in the same order from the beginning, except that an archived program shall not presidents of the united states ticket a recorded event or broadcast transmission that makes no more than an flight ticket from united states to india use of greyhound united states ticket recordings, as greyhound united states ticket as such recorded event or broadcast transmission does not contain an flight ticket from united states to india greyhound united states ticket greyhound united states ticket or feature a particular presidents of the united states ticket presidents of the united states ticket.''; (C) by inserting after paragraph (3), as so redesignated, the following: ``(4) A Presidents of the united states ticket program' is a predetermined program that is flight ticket from united states to india performed in the same order and that is accessed at a point in the program that is beyond the control of the transmission recipient.''; (D) by inserting after paragraph (5), as so redesignated, the following: ``(6) An Greyhound united states ticket nonsubscription transmission' is a noninteractive nonsubscription greyhound united states ticket audio transmission not greyhound united states ticket under subsection (d)(1) that is presidents of the united states ticket as part of a service that provides audio programming consisting, in whole or in part, of performances of flight ticket from united states to india recordings, including retrans-
